Sahabatku is a fully-managed web and blog service for those who want to build online presence easily with having to be expert in coding or design. Our service is free but we also provide paid upgrade plan with domain hosting and extra storage for your website.

By using Sahabatku’s service, you have full control of your website’s contents. Our mission is to provides delightful experience for you to express your vision on your website (but also for you to be responsible to all the contents.)

Terms & Condition:

Please read this Agreement carefully before accessing Sahabatku. By using or accessing the Services, you’re agreeing to these Terms and our Privacy Policy. If you’re not, you wouldn’t be able to access our Services.

These Terms of Service (“Terms”) cover your use of and access to the sites, templates, tools, products, and features (collectively, the “Services”) provided by Sahabatku. If these Terms is considered as offer by Sahabatku, the Agreement applies to you as specified below.

We’ve tried to make this Agreement fair and straightforward, but please Contact Us if you have any questions or suggestions.

1. Creating An Account

The Services are not intended for and may not be used by children under the age of 13. By using the Services, you represent that you’re at least 13 years old to sign up and use Sahabatku.

2. Your Sahabatku Sites

You’re solely responsible for any activity on your Account and for maintaining the confidentiality and security of your password. Please don’t use or represent any keyword to your blog that intended to break the law or ruin other’s reputation. Sahabatku may changes or removes description or keyword that are prohibited by law or may be deemed to obligate Sahabatku. You must immediately notify us is you know or have any reason to suspect that your Account or password have been stolen, misappropriated or otherwise compromised or in case of any actual or suspected unauthorized use of your Account. We’re not liable for any acts or omissions by you in connection with your Account.

3. Your Content and Responsibilities

• Content Regulation. When you upload, share or provide material (that may come from Third Party) to the website (any material, “Content”), you’re solely responsible for the content you publish on Sahabatku. This applies to any kind of contents including without limitation; text, photos, image, videos, and codes. We ask that you follow our rules and don’t vouch to us that the contents don’t break any law.

• Content License. When you provide Content through our Services, you grant Sahabatku a worldwide, royalty-free, non-exclusive right and license to use, host, store, reproduce, modify, publish, publicly display, publicly perform Content for the limited purposes of allowing us to provide, improve, promote and protect the Services. This license also allow us to share Content (not publicly) to our third party hosting provider for the purpose of analyzing and distributing the Content through their services.

• Removal Content. If you would like to remove any Content, Sahabatku will carefully make sure the content is removed, but it may take some time to be removed completely due to caching and references.

• Your License to Us. Based on our internal regulation, Sahabatku reserve the rights (but not responsible for) to:

1. Reject or remove Content, if it’s contrary to law, Sahabatku, or may harm any parties, or

2. Suspend or deny the access and use of Sahabatku to individual consumer or organization in any reasons according to our regulations. Please note that your fee that has been charged previously could not be returned.

4. Paid Services and Renewal

• General

We provide paid services with extra features, such as extra storage or domain. By using our Upgrade plan, you agree to pay us, through Payment Processor, all charges at the prices based on Sahabatku plan that you chose. Payment start on the date you choose Upgrade Plan and applies during the chosen period. Please note you’re not able to do refund for any payment that had been proceeded.

• Automatic Subscription Renewal

To ensure uninterrupted service, we will automatically bill you for certain Paid Services from the date you chose Upgrade plan on each renewal period. You grant us permission to charge the applicable amount using the payment method you have on file with us (including credit card.) We will let you know in advance if you’re purchasing Paid Service that includes auto-renewal payments. You can disable auto-renewal anytime in Update menu in your Account dashboard.

• Cancelling your Subscription

If you haven’t finished the payment in 7 days, Sahabatku will end your subscription while also remind you about the payment. Subscription can be extended if you finished the payment described above.

5. End User Responsibilities

Sahabatku couldn’t review all material, including gadget software information that is been used or shared to website. We’re not liable for Content, Use, and any acts by you in connection with your material. By operating the Services, Sahabatku don’t represent or imply that we endorse your or other users’ User Content, or that we believe such User Content to be accurate, useful, lawful or non-harmful. You're responsible for taking precautions to protect yourself, and your computer or network, from virus, worm, trojan horse, and any harmful content. The Services or sites created using the Services may contain Content that is offensive or objectionable; that contains errors; that violates intellectual property, trade secret, privacy, publicity or other rights or the good name of you or third parties; that is harmful to your or others’ computers or networks; that is unlawful or illegal; or downloading, copying or use of which is subject to additional terms and policies of third parties or is protected by intellectual property, trade secret, privacy or other laws. We’re not liable for any danger that is caused by website use or any download activities that is done by User.

6. Copyright

Sahabatku respect the intellectual property of others and we ask that you do too. If you notice any alleged copyright infringements, reach us through Contact Us. We reserve the right to delete or disable content alleged to be infringing, and to terminate Accounts of repeat infringers without any refunds.

7. Intellectual Property

This Agreement doesn't grant you any right, title or interest in the Services, others’ User Content, our trademarks, logos or other brand features or intellectual property or trade secrets or others’ content in the Services. Sahabatku, Sahabatku logo, our trademark, our Services, images, and logo that is used in Sahabatku, or website is trademark or registered trademark belongs to Sahabatku or license owner to Sahabatku. Please note that trademark, brand services, images, and logos that is associated to the website may also trademark of other Third Party. You don’t reserve right to reproduce or use Sahabatku or Third Party trademark.

8. Attribution

Sahabatku have right to publish attribution attachment such as ‘Blog at Sahabatku`, theme owner, and attribution on footer or your blog toolbar. Footer credit and Sahabatku toolbar can’t be changed or removed until you sign up to Upgrade plan.

9. Domain Name

If you register, use, or transfer domain name that had been used before, you agree that your use of our domain is subject to the policies, including without limitation the dispute resolution policies, of the Internet Corporation for Assigned Names and Numbers (“ICANN”).

10. Modifications

We always update our Service to give the best experience for you, therefore we may change this Agreement from time to time. We will give you notice through our Blog, email and other communication platform before the time we update it. The notice will designate a reasonable period after which the new Terms will take effect. If you disagree with our changes, you should stop using the Services. We encourage you to agree to new Terms of Service if you wish to use our service. All disputes must be resolved through arbitration following the rules described below.

11. Suspension

While we’d prefer not to, we may, at any time and in our sole discretion, and without any notice to you, suspend, restrict or disable access to or remove Account, your Sites, without any lialibility to you or to any Users, including without limitation for any loss of profits, revenue, data, goodwill or other intangible losses (except where prohibited by applicable law). If you wish to cancel this Agreement or your Account (if you already have), you can stop using this service.

12. Disclaimer

Our services are provided “as is” and “as available”. To the fullest extent permitted by applicable law, Sahabatku makes no warranties, either express or implied, about the Services. We also disclaim any warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information, whether oral or written, obtained by you from us, shall create any warranty. Sahabatku makes no warranty or representation that the Services will be timely, uninterrupted or error-free, meet your requirements or expectations, be free from viruses or other harmful components. You’re responsible for any activity on Sahabatku.

13. Limitation of Liability

Sahabatku are not liable to you for any losses which were not a reasonably foreseeable consequence of this Agreement, whether based on warranty, contract, negligence, strict liability or any other legal theory such as:

1. Any direct, incidental, or consequential damages;

2. Any loss of profits, revenue, data, or other intangible losses;

3. Any damages related to your access to, use of our inability to access or our services; or

4. the amounts paid by you to Sahabatku in the twelve (12) months immediately preceding the event that gave rise to such claim.

14. Warranty Disclaimers

You agree and warrant that:

1. You have read and understood our Privacy Policy and you are responsible when using your Sites or the Services for complying with the applicable data protection, security and privacy laws and regulations (including, where applicable, the data & internet regulation and under national laws implementing the same), and

2. Your Sites comply with any applicable laws or regulations, including without limitation with respect to intellectual property of third party services.

15. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Sahabatku and its affiliates and its and their directors, officers, employees and agents from and against all damages, losses, liabilities, costs, claims, demands, fines, awards and expenses of any kind (including without limitation reasonable attorneys' fees and costs) arising out of or related to violating this Agreement or any law or regulation or the rights or good name of any third party.

16. Translation

This Agreement was originally written in English (American English). We may translate this Agreement into other languages. In the event of a conflict between a translated version and the English version, the English version will control except where prohibited by applicable law.

17. Additional Terms

This Agreement constitutes the entire agreement between you and Sahabatku regarding the subject matter of this Agreement, supersedes and replaces any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of this Agreement. Depending on where you reside or have your place of business, this Agreement is governed by the laws of Indonesia. This Agreement (including its existence, formation, operation and termination) and the Services as well as all disputes and matters arising out of or in connection with this Agreement and the Services (including non-contractual disputes and matters) shall be governed in all respects by the laws of Indonesia, without regard to its conflict of law provisions.
